Developer Requirements for Community Housing

An applicant of any new, commercial, accommodations, or residential development permit or subdivision within Mt. Crested Butte is subject to the requirements set forth in Chapter 22 of the Mt Crested Butte Town Code.

The following are the minimum requirements in order for Planned Unit Development and Subdivision approvals and issuance of a building permit:

Commercial Employee Housing Mitigation
All commercial construction that results in a net increase of space must produce at least 15% of the housing units for which demand is generated by on-site, permanent employment; dwellings must be affordable as defined for households with incomes at or below 80% AMI (Category 1)and deed restricted (Level 1).  Commercial additions less than 500 square feet are exempt.

Accommodations Employee Housing Mitigation
Accommodations developed within the Downtown Development Authority District (DDA) must produce at least 30% of the housing units for which demand is generated by on-site, permanent employment. Accommodations outside the boundaries of the DDA must produce at least 15% of the housing units for which demand is generated on-site, permanent employment. Dwellings must be affordable as defined for households with incomes at or below 80% AMI (Category 1) and deed restricted (Level 1).

Residential Housing Mitigation
All residential development must produce at least 30% of the housing units for which demand is generated by on-site, permanent employment; dwellings must be affordable as defined for households with incomes at or below 80% AMI (Category 1) and deed restricted (Level 1). Residential additions less than 500 square feet are exempt.

Inclusionary Zoning
At least 15% of all residential units developed shall be deed restricted for households with incomes between 81% and 120% AMI (Category 2) and deed restricted (Level 2). Single Family Lots platted prior to the adoption of this regulation (January 31, 2003) are exempt. Also all lots within the DDA are exempt from these regulations.
